Zeepay, Andrew Takyi Appiah sue MTN, MMFL for GHS15 million over alleged breach of contract

Zeepay Ghana Limited and its Managing Director, Andrew Takyi-Appiah, have sued Scancom PLC, which operates MTN Ghana, and Mobile Money Fintech Limited (MMFL) at the High Court in Accra over the registration of the company’s corporate mobile money wallet in his name.

The writ of summons, filed on 23 October 2026, seeks GH¢15 million in damages for Mr Takyi-Appiah, along with general damages for breach of contract for Zeepay.

Zeepay says it subscribed to an MTN Mobile Money corporate wallet (OVA wallet) around 2022/2023. According to the statement of claim, it later learnt that the defendants had registered the wallet in Mr Takyi-Appiah’s name, although the documents used to subscribe, including the KYC documents, were in the company’s name.

The plaintiffs said Zeepay wrote to the defendants on 21 November 2023, instructing them to change the wallet’s ownership to the company’s name. Zeepay said it supplied the necessary documents, but the defendants refused or neglected to act despite reminders up to August 2026. The wallet still bore Mr Takyi-Appiah’s name when the suit was commenced, the plaintiffs said.

Zeepay v MTN

Mr Takyi-Appiah said he has suffered pain, distress and reputational harm. He said he has been made a party to Zeepay’s litigation, and that in all of the company’s pending cases at the High Court in Accra, the courts have declined to remove him as a party because his name remains on the wallet’s ownership records.

The plaintiffs said the defendants cited Mr Takyi-Appiah as a handler of the wallet to justify using his name, which they described as baseless because the holder of an OVA wallet is not necessarily its owner. They called the defendants’ conduct “oppressive, arrogant and a complete disregard of the rights” of both plaintiffs.

The plaintiffs are asking the court for:

  • declarations that registering the wallet in his name was wrongful and unlawful, that the defendants breached their duty to Zeepay, and that they are liable for any harm he has suffered;
  • an order directing the defendants to remove his name and comply with Zeepay’s November 2023 instructions;
  • general damages for breach of contract for Zeepay;
  • GH¢10 million in general damages and GH¢5 million in exemplary damages for Mr Takyi-Appiah; and
  • costs, including legal fees, and any other orders the court considers fit.

The writ commands the defendants to enter an appearance within eight days of service. The claims have not been tested in court.
